These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MotionZync ("we," "us," "our," or "the Platform") governing your access to and use of the MotionZync website and all associated services, tools, and content.

By accessing or using MotionZync in any manner, including browsing the website, using the Playground, AnimCreator, CodeSpace, downloading wallpapers, enrolling in courses, or submitting animations, you acknowledge that you have read, understood, and agree to be bound by these Terms.

These Terms apply to all visitors, users, and others who access or use the Service. They should be read in conjunction with our Privacy Policy and Disclaimer, which are incorporated herein by reference.

MotionZync is a free online platform providing the following services:

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of services.

MotionZync is available to users worldwide. By using the Service, you represent that:

• You are at least 13 years of age (or the minimum age of digital consent in your country/region)
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under applicable laws of your jurisdiction
• You will comply with these Terms and all applicable local, national, and international laws

If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and consented to these Terms on your behalf. Parents/guardians are responsible for supervising minors' use of the Service.

When using MotionZync, you agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. Specifically, you agree NOT to:

• Submit, upload, or display any animation code that contains malicious code, malware, viruses, trojans, ransomware, keyloggers, or any other harmful programs
• Attempt to gain unauthorized access to any portion of the Service, server infrastructure, database, or other user accounts
• Use automated tools, bots, scrapers, or crawlers to bulk-download content from the platform without our express written permission
• Submit or display content that is illegal, defamatory, harassing, threatening, abusive, obscene, pornographic, or violates any applicable law
• Impersonate MotionZync, its team, or any other person or entity in a misleading or deceptive manner
• Use the Service to collect personal information from other users without their consent
• Attempt to reverse engineer, decompile, or extract source code of proprietary platform components
• Interfere with or disrupt the integrity or performance of the Service or its associated infrastructure
• Use the Service to conduct any form of commercial advertising or spam without prior written consent
• Circumvent, disable, or otherwise interfere with security features of the platform

Understanding who owns what on MotionZync:

All MotionZync trademarks, logos, service marks, trade names, and other proprietary designations used on the Service are trademarks of MotionZync. Any unauthorized use of our intellectual property is strictly prohibited and may result in legal action.

MotionZync allows users to submit animations for potential inclusion in the gallery. By submitting content:

• You represent that you are the original creator of the submitted animation, or have the right to submit it
• You represent that your submission does not infringe any third-party intellectual property, privacy, or other rights
• You grant MotionZync a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, display, distribute, and modify your submitted animation for the purpose of operating and promoting the Service
• You understand that submitted animations undergo admin review before publication and may be rejected or edited
• You understand that once published, your animation may be used, copied, and modified by other users under the platform's usage terms

MotionZync reserves the right to remove any submitted content at any time for any reason, including but not limited to violations of these Terms or applicable laws.

MotionZync displays advertisements through Google AdSense to sustain the platform and keep all services free for users.

• Ads are served by Google AdSense and governed by Google's advertising policies
• MotionZync does not endorse any products, services, or companies advertised on the platform
• MotionZync is not responsible for the content, accuracy, or legality of third-party advertisements
• Clicking on advertisements may take you to external websites governed by their own terms and privacy policies
• You agree not to use ad-blocking software or browser extensions to circumvent advertisements on MotionZync, as advertising revenue supports the free availability of the platform
• Wallpaper downloads may require viewing a short advertisement before the download begins

MotionZync provides advanced creative tools — CodeSpace (browser-based IDE) and AnimCreator (visual animation designer). By using these tools:

• Local Storage: CodeSpace and AnimCreator store all project data in your browser's local storage (IndexedDB). This data remains on your device and is not transmitted to our servers.
• No Cloud Sync: Projects created in CodeSpace/AnimCreator are not backed up to the cloud. You are responsible for exporting and backing up your work.
• Exported Content: Code exported from CodeSpace or animations exported from AnimCreator belong to you and can be used freely in personal and commercial projects.
• Third-Party Libraries: CodeSpace may load libraries from CDNs. These are governed by their respective licenses (MIT, Apache, etc.).
• No Liability for Data Loss: We are not responsible for any loss of work created in CodeSpace or AnimCreator due to browser clearing, device failure, or any other reason.

MotionZync allows users to download animations as HTML-based live wallpapers. Regarding wallpaper downloads:

• Downloaded wallpapers are provided as HTML files for personal use only
• You may not redistribute, sell, or sublicense downloaded wallpapers
• Setting HTML files as live wallpapers requires third-party wallpaper applications (e.g., KLWP for Android, Lively Wallpaper for Windows). MotionZync is not affiliated with these applications.
• MotionZync is not responsible for any device performance impacts, battery drain, overheating, or any other issues caused by using HTML wallpapers on your device
• A short advertisement may be required to be viewed before a wallpaper download commences
• Downloaded wallpaper files are provided "as is" without any warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE MOTIONZYNC SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED
• WE EXPRESSLY DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE
• WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY CONTENT, INCLUDING ANIMATION CODE, COURSE MATERIALS, OR ANY OTHER INFORMATION ON THE PLATFORM
• YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOTIONZYNC, ITS OPERATORS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or other intangible losses
• Damages resulting from your use of or inability to use the Service
• Damages resulting from unauthorized access to or alteration of your data
• Any bugs, errors, or inaccuracies in animation code obtained from the platform
• Any device damage caused by downloaded wallpapers or executed code
• Any damages arising from third-party advertisements displayed on the platform

These limitations apply whether liability is based on warranty, contract, tort (including negligence), product liability, or any other legal theory, even if MotionZync has been advised of the possibility of such damages.

Where jurisdiction does not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law. In all cases, our maximum aggregate liability shall not exceed USD $0 (zero), as MotionZync is a free service.

You agree to defend, indemnify, and hold harmless MotionZync, its operators, contributors, partners, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in any way related to:

• Your use of or access to the Service
• Your violation of any provision of these Terms
• Your violation of any third-party right, including any intellectual property right, privacy right, or other proprietary right
• Any content you submit, post, or make available through the Service
• Your violation of any applicable law, rule, or regulation

This indemnification obligation survives the termination of these Terms and your use of the Service.

MotionZync reserves the right to:

• Terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms
• Remove any content you have submitted that violates these Terms
• Modify, suspend, or discontinue the Service (or any part thereof) at any time

Upon termination, your right to use the Service will immediately cease. Since no account is required for regular users, "termination" refers to IP-based or technical access restrictions if abuse is detected.

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of India (the jurisdiction of the platform operator), without regard to conflict of law provisions.

• Informal Resolution: Before initiating any formal legal proceeding, you agree to first contact us at wealthkavach1@gmail.com to attempt to resolve disputes informally
• Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India)
• Class Action Waiver: You agree to resolve any disputes on an individual basis and not as part of a class, consolidated, or representative action
• Jurisdiction: For any matters not subject to arbitration, you consent to exclusive jurisdiction in Indian courts

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

We reserve the right to modify or replace these Terms at any time at our sole discretion. When changes are made:

• The "Last Updated" date will be revised at the top of this page
• For material changes, we may provide notice on the website or through other means
• Continued use of the Service after changes constitutes binding acceptance of the revised Terms
• If you disagree with revised Terms, you must discontinue use of the Service
